Easements

Much of the electricity infrastructure throughout Tasmania is not supported by a registered easement on title.

Under section 11 of the Electricity Wayleaves and Easements Act 2000, (the Act) electricity infrastructure that existed on, over or under land before 6 November 1996, and is not supported by a wayleave or other easement, now benefits from a deemed easement to enable the electricity entity (TasNetworks) to enter upon land to maintain its infrastructure.

In effect, where electricity infrastructure crosses land and there is no easement on title, that infrastructure is supported by a deemed easement created under the Act.

Today, when new infrastructure is installed, it is necessary for the person requesting the supply to arrange any easements necessary to support that infrastructure.
